  • Clients or potential clients interested in leasing as a tenant or purchasing properties (referred to, among others, as property seeker or potential client holder);

  • Owner clients who wish to sell or lease a property;

  • Other intervening parties participating in any relocation operation or service.

The personal data provided by data subjects through the various data entry channels, commitment documents, contracts, or other channels during the process may include, among others, identification, contact, financial, situational environment, and billing data.

3. PURPOSES OF PROCESSING AND LAWFUL BASES

Our company collects your personal data for the following purposes:

3.1. Relocation services

Within the framework of providing relocation services, whether for the sale or lease of a property or other services, it is necessary to process the personal data of the intervening data subjects. Such processing is carried out, in accordance with applicable regulations, based on the performance of pre-contractual or contractual measures, and with the aim of providing our relocation services and fulfilling the corresponding obligations.

In this context, we may use your data whether a contractual relationship already exists with our company, or if you are in an initial contact or service exploration phase.

To initiate any relocation service, we may contact you both by telephone and by electronic means (email, text message, or even instant messaging applications), which includes, in any case, sending information about services in which you have shown interest.

Likewise, it includes the necessary procedures to assist you in the formalities related to the sale or lease of a property, even during the preliminary phase in which options are evaluated, information is exchanged, or a potential collaboration is studied.

This processing spans from capturing an opportunity to the formalization of the transaction, including compliance with obligations derived from a contract, pre-contract, or brokerage agreement, where applicable. Likewise, it includes the monitoring and control of ongoing operations, the organization and management of property viewings, the coordination of schedules between interested parties, the transmission of offers and counteroffers, and assistance in negotiations between buyer and seller or lessor and lessee.

Furthermore, we may collect, review, and deliver the necessary documentation for the process, such as land registry certificates (notas simples), energy performance certificates, property deeds, earnest money contracts (contratos de arras), or pre-agreements, even in phases prior to the formal hiring of our services. We may also accompany you in administrative or legal procedures before public bodies, notary offices, or land registries, always with your consent when required.

We will keep you informed of any eventuality, update, or incident that may arise during the process, such as delays in the delivery of documentation, cancellations of viewings, changes in property conditions, legislative amendments, or other relevant situations that may influence the correct development of the brokerage. This may include sending electronic communications for non-commercial purposes.

In addition, with your express authorization when necessary, we may carry out procedures on your behalf, such as submitting documents, filing requests before public bodies, coordinating with notary offices or land registries, or setting up utility supplies linked to the property.

Likewise, we inform you that, within the framework of the activities necessary for the correct brokerage of services, we may communicate your personal data to third parties.

Finally, in cases where a contractual relationship has been formalized, we will also process your data to issue the corresponding invoices for the services rendered and manage the collection of fees derived from our professional services.

The processing of your data will be limited exclusively to what is necessary to carry out these purposes and ensure proper brokerage, in compliance with the applicable legal framework.

3.2. Sending commercial communications

During the provision of our relocation services, we may request your consent to send you commercial communications by electronic means, including but not limited to email, text messages, or instant messaging applications.

You may revoke your consent and object to the sending of such communications at any time through the means enabled by our company.

3.3. Sending communications to gather your opinion

In order to continuously improve our services, we process your personal data to learn your detailed feedback and opinions on the services provided. In this regard, we may send you satisfaction or opinion surveys regarding our services, which will always and in all cases be optional.

In order to address the inquiries and communications you direct to us through the contact form, we process the personal data you provide.

4. RETENTION PERIODS

Your data will be retained for the period strictly necessary to achieve the purposes of the processing, without prejudice to its retention for the purpose of making it available to competent authorities and for handling claims.

In such cases, the data will be kept blocked until the expiration of the statutory limitation period, at which point it will be deleted.

In particular, you are informed that the company will retain for a period of ten years the documentation formalizing compliance with the obligations established in Law 10/2010, of April 28, on the prevention of money laundering and terrorist financing, proceeding to its erasure thereafter.

After five years have elapsed since the termination of the business relationship or the execution of the occasional transaction, the retained documentation will only be accessible by the internal control bodies of the obliged entity, including technical prevention units, and, where applicable, those responsible for its legal defense.

Likewise, you are informed that the company may retain your duly anonymized data for statistical or market research purposes, whenever possible, without prejudice to the due blocking required to comply with any applicable legal obligation.

5. PROFILING

As described below, Coastal Living may carry out user profiling, taking into account all the data provided by you.

Such profile will take into account, for example:

  • User behavior on the website, based on selected services, cursor movements, interests, and preferences.

  • Behavior regarding the delivery of our commercial or informational communications, such as which content is of interest to you based on the opening of commercial communications and the frequency of opening.

  • Interaction you may carry out through other channels, such as inquiries in our information or contact channels.

  • Information you may provide to us through satisfaction surveys.

We further inform you that, for some services, we may process your personal data using automated means. This means that certain decisions are made automatically without human intervention, such as segmenting you based on the interest you show in specific sections of the website or the potential use of other services we may offer.

In the event that you have accepted to receive commercial communications, these may be adapted and personalized according to the users' interests, either based on the services requested or based on data we can infer or obtain from your browsing history, interest in certain content, or reaction to our communications, among others.

Such personalization is carried out in a partially automated manner, in the sense that our company determines the personalization parameters, but the technological platform is what generates the user profile. We do not send general communications that are not segmented through the aforementioned procedure, as we consider it to be in both our interest and the user's interest to send or receive information that is relevant, and because the absence of segmentation would not alter the number of communications received, but only their content. In this sense, if you do not wish to be segmented, please do not subscribe to commercial communications.

In any case, at no time does any automated or partially automated decision, including the profiling described, entail legal effects on the data subject, nor will it significantly affect them in a similar manner.

6. EXERCISE OF RIGHTS

You may exercise your rights of access, rectification, erasure, objection, restriction of processing, and data portability by sending an email to the following address: info@coastal-living.es, including the reference “Personal Data”. If necessary, additional documentation regarding identification may be requested.

Likewise, you may revoke the consent granted for those processing operations based on consent and/or object to other processing operations whenever possible under current regulations. Without prejudice to the foregoing, the revocation of or objection to certain processing operations may result in our inability to provide certain services.

You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), https://www.aepd.es/, the competent authority in Spain for data protection matters, if you consider that your data has not been processed correctly.

7. CONFIDENTIALITY AND SECURITY IN DATA PROCESSING

Data received by our company will be treated with the utmost secrecy and confidentiality. Our company has established all technical and organizational means within its reach to prevent the loss, misuse, alteration, unauthorized access, or copying of the data provided.

8. INTERNATIONAL TRANSFERS

In the event that third parties assisting us in the provision of services process your personal data in territories outside the European Union or the European Economic Area, Coastal Living will ensure that your data is always protected with the necessary safeguards, which may include:
